Abstract: California has adopted some of the world’s most ambitious sustainability targets, yet it is not on pace to meet many of them. While technical and financial barriers remain, critical institutional barriers also impede implementation. Excessive veto points constrain housing and land use reform; supermajority voter approval requirements have resulted in a public transportation funding crisis; and large numbers of complex or poorly designed ballot initiatives divert both public attention and advocacy resources away from efforts to achieve key sustainability goals. These problems point to a lawmaking system that is poorly balanced – misallocating flexibility and care while also failing to create space for the iterative, inclusive deliberation necessary to advance effective solutions. This practitioner-oriented paper treats constitutional modernization not as abstract democratic reform, but as a necessity for sustainability transformation. Using German federal and state systems for constitutional amendment, direct democracy, and deliberative democracy as case studies, it identifies practical principles for California: calibrate the balance between flexibility and care in lawmaking to the sensitivity of the subject; place direct and representative democracy on roughly equal footing; keep decisions reversible in practice; and embed deliberation throughout the lawmaking cycle. It concludes with a call to treat democratic function as essential to achieving sustainability movement goals.
